1. Agreement between the customer and NHCS

Use of this website implies full acceptance of these terms & conditions. If you do not agree to these Terms of Use, you are not authorized to use this website.
At any moment, NHCS may amend these Terms of Use. The continued use of this website is dependent on your acceptance of these amended conditions.
2. USE OF THE WEBSITE
As a condition of your use of this website, you hereby guarantee that (i) you are at least 18 years of age, (ii) you have the legal power to enter into a legally binding obligation, (iii) you will use this website pursuant to these Terms of Use, (iv) you will solely use this website to make legitimate reservations for yourself or for another person on whose behalf you are legally authorised to act, (v) you will notify the aforesaid other per-sons as to the terms & conditions applicable to the reservations that you are making on their behalf, includ-ing all terms and restrictions established by the supplier which may be applicable, (vi) all the information that you provide to this website is true, accurate, complete and up-to-date and (vii) if you have an NHCS account, you will ensure the veracity of the information pertaining thereto and be aware of its status. Furthermore, you declare that you are fully responsible for its use thereof and will ensure that it is not used by anybody else. NHCS has the right to deny access to the website and the service that we offer to any person who is in breach of these terms of use.
3. PROHIBITED USES
The content and information that feature on this website (including but not limited to the quoted prices and availability of travel services), as well as the infrastructure used to provide this information and content, is the property of our suppliers. You may make a limited number of copies of your itinerary (and related documents) relating to your travel and the services you have reserved through this website. However, you hereby undertake not to alter, copy, distribute, convey, show, transact, reproduce, publish, issue licences, create worked derived therefrom, transfer, sell or resell any information, software, products or services obtained from or through this website. If your reservation or account shows credible signs of fraud, abuse or suspicious activity, NHCS may cancel any reservation associated with your name, email address or account, as well as closing any associated NHCS accounts. If you have committed any fraudulent act of any kind, NHCS reserves the right to take any legal or judicial action that may be required and through which you may be held liable for any financial loss suffered by the company, including procedural costs and compensation for damages incurred. We are always interested to hear your opinions. Bear in mind that by sending information via email or posting comments on this website or through any other media, including opinions on hotels, other opinions, questions, comments, suggestions, ideas or similar content (collectively referred to as "publications"), you hereby grant NHCS a non-exclusive license, royalty-free where this is permissible under current applicable law, which is transferable, irrevocable and fully sub-licensable, granting the aforesaid companies and affili-ates the right to: (a) use, reproduce, alter, adapt, translate, distribute, publish, create work derived there-from and publicly display and run the aforesaid publications worldwide in scope and via any media and (b) use the name that you send in connection to the publications. You hereby recognize and consent to NHCS companies and affiliates including references in your comments and reviews (for example, the use of your name and place of birth in the opinion you submit) at its discretion. These publications may be shared with our supplier partners. You also grant NHCS the right to legally pursue any person or organization that violates your rights or those of NHCS through these publications. You hereby recognize and accept that these publications are not confidential, nor shall they be deemed to be exclusive property. You thus confirm that you have no objection to their publication, use, alteration, deletion or exploitation by NHCS. We accept no liability for any publication that you submit. We have no obligation to publish your comments, while we reserve the right to determine, at our absolute discretion, which comments are published on the website. At times we offer customers incentives, such as discount coupons or the right to take part in special promotions and prize draws in return for expressing their comments and opinions on hotel stays. As it is important to us that the comments from hotel guests are impartial and honest, these incentives will be given to customers regardless of whether their opinion or comment on their stay is positive or negative.
You are fully responsible for the content of your publications, (specifically including but not limited to comments published on this website). NHCS liability in respect of these Web site terms, conditions and notices is set out in Article 8 of the General Terms and Conditions for Booking, which is incorporated by reference into these Web site terms, conditions and notices.
7. THE ABSENCE OF ILLEGAL OR PROHIBITED USE
One of the conditions of your use of this website requires that you guarantee NHCS that you will not use this website for any illegal purpose or which is prohibited by these Terms of Use.
8. LINKS TO THIRD-PARTY WEBSITES
This website may contain links to websites managed by third parties external to NHCS. Such links have been included solely for your reference. NHCS has no control over these websites and is not responsible for their content or the use thereof. The inclusion by NHCS of links to these websites does not imply any approval of the material that they contain or to the relationship with the third parties that administer them.
9. SOFTWARE AVAILABLE ON THIS WEBSITE
All the software that is available on this website for download is the work of NHCS, and/or their respective suppliers. Your use of this software is covered by the clauses set forth in the end user license agreement (the "license agreement"), which, where present, accompanies or is included with the software. You may only install or use the software for which you have a license agreement if you first accept the conditions thereof. With regard to the software that is available for download on this website and which is not accompanied by a license agreement, NHCS hereby grants you, the user, the personal, non-exclusive and non-transferable right to use the software worldwide and for an indefinite and unlimited time in order to visit and otherwise use the website and/or access the content and information on the mobile app (including but not limited to the prices and availability of travel services) pursuant to these Terms of Use and for no other purpose.
Bear in mind that all software, including but not limited to HTML code and Active X controls included on this website, is the property of NHCS and/or their respective suppliers and is protected by copyright law and international treaties. Any reproduction or distribution of the software is expressly prohibited and may incur severe civil and criminal penalties. Offenders will be pursued to the full extent of the law.
Except where the corresponding license agreement stipulates otherwise, the software solely allows you as the user to make back-up copies and files. The making of future copies and reproductions is prohibited, as is all future distribution of software. Only the guarantees expressly set forth in the corresponding license agreement are applicable to the software. NHCS expressly dismisses any other guarantee of any kind, including those related to its sale or suitability for a particular end or a guarantee the software is not contravening any rights.
NOTWITHSTANDING THE FOREGOING, ANY COPY OR REPRODUCTION OF THE SOFTWARE ON ANOTHER SERVER OR LOCATION FOR ITS SUBSEQUENT REPRODUCTION OR DISTRIBUTION IS EXPRESSLY PROHIBITED. SOFTWARE IS GUARANTEED ONLY WITHIN THE CONTEXT OF THE TERMS OF THE LICENCE AGREEMENT.
10. EXCHANGE RATES
If a currency converter is available on the website, the following terms and conditions shall apply: Exchange rates are calculated on the basis of various public sources and are only shown as an indication. Exchange rates may not be accurate and might vary. Currency rates may not be updated every day. Check the date on which the exchange rate was last updated on the currency converter. The information provided by this app strives to be accurate. Nevertheless, NHCS and/or their respective suppliers cannot guarantee this accuracy. By using this information for any financial purpose, we advise you to consult a qualified professional to check exact exchange rates. We do not authorise the use of this information for any purpose other than your personal use. The resale, distribution and use of this information for commercial ends is expressly prohibited.
11. BANK CHARGES AND CREDIT CARD COMMISSIONS
Some banks and credit cards may charge for international transactions. If you are making a reservation from outside Portugal through a Portuguese credit card, your bank may calculate the amount of the reservation to be paid in the local currency and charge an exchange fee. This means that the sum appearing on your credit card or bank account statement may appear in the local currency. A different figure may therefore be shown to the one that appears on the invoice summary for the reservation made on the website. An international transaction commission may be charged if the bank that issued the credit card is outside Portugal. Interna-tional travel reservations may be regarded as an international transaction by the bank or credit card company, as NHCS may pass payment to international travel providers. Currency exchange rates and fees for international transactions shall be solely determined by your bank on the day on which the operation is processed. If you have any question concerning these charges or the exchange rate applied to your reservation, please contact your bank.
12. INTELLECTUAL PROPERTY RIGHTS AND COMMERCIAL TRADEMARKS

13. COUNTER NOTIFICATIONS
NHCS respects third-party copyright. If, in good faith, you believe that the material we have included infringes your copyright, you (or your agent) may submit written notification, providing the following information. Please bear in mind that we will not process your complaint if it is not submitted correctly or if it is incomplete:

14. CANCELLATION OF AN ACCOUNT
In appropriate circumstances and where there is reasonable evidence, NHCS applies a cancellation policy for subscribers or account holders deemed to be repeat offenders. NHCS may also, where there is reasonable evidence, limit access to the website and/or cancel the accounts of users who infringe upon the intellectual property rights of others, regardless of whether the offence is repeated or not. If you believe that a subscriber or account holder is a repeat infringer, please send notification which includes enough information for us to verify that the aforesaid party is indeed a repeat offender.
15. COUNTER NOTIFICATIONS
NHCS will not tolerate false complaints of copyright infringement. If you believe that the content that you submitted to the website was deleted due to a false complaint of copyright infringement, you may present a counter notification. Whenever we receive a duly presented counter notification, it is then passed on to the owner of the copyright in question.
In order to submit a notification, it should be presented in writing by fax or post that includes all the elements specified below. 16. AMENDMENTS TO THESE TERMS OF USE
NHCS reserves the right to amend these Terms of Use on the basis of which this website is offered, giving due notice. The continued use of this website shall imply acceptance of the amended Terms of Use.
17. GENERAL ASPECTS
This agreement is governed by Portuguese Law. The user submits to the exclusive jurisdiction of the courts of Portugal in the case of any dispute related to or arising from use of this website. Use of this website is not authorised in any jurisdiction that does not give effect to all provisions of these Terms of Use, including but not limited to this paragraph.

You expressly agree and consent to grant NHCS the right to assign, convey, subcontract or delegate the rights, duties or obligations under this agreement.
You also agree and consent that there is no union of companies, association or employment or agency relationship between you and NHCS, as a result of this agreement or use of the website.
Compliance by NHCS of this agreement is subject to current law and legal procedures. No part thereof repeals any rights of NHCS by complying with the requirements governing the use of this website and the information supplied or gathered by NHCS with respect to this use.
If any part of this agreement is deemed invalid or unenforceable pursuant to applicable law, including but not limited to restrictions on guarantees and the previously cited exemption from liability, the aforesaid invalid or unenforceable provision will be replaced by a valid section which is as close as possible to the intention of the parties included in the original wording. The rest of the agreement will continue to be valid.
This agreement represents a complete contract between you, the customer, and NHCSwith regard to this website. It replaces all prior or contemporaneous communications and proposals, be they electronic, oral or written, between the customer and NHCS concerning the website. A printed version of this agreement and any other notification submitted by electronic means will be admissible in legal or administrative proceedings based on or related to this agreement to the same extent and subject to the same conditions that apply to other documents and files originally created and maintained in printed form.
The fictitious names of the companies, products, people, characteristics and/or data mentioned herein do not seek to represent any person, company, product or event.
All rights not expressly granted herein are reserved.
